Terms of service
These Terms of Service (“Terms”) govern your access to and use of the Lumihour website, and the purchase of any products or services made available through it (together, the “Services”). By accessing the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Who we are
Lumihour (“we”, “us”, “our”) is the trading name under which these Services are provided. [Business/legal entity name and registered address to be added here once business registration is complete.] You can contact us at support@lumi.com
Lumihour is powered by Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order through the Services. By using the Services, you confirm that you meet this requirement and that any information you provide us is accurate and complete.
3. Products and Descriptions
We aim to describe and display our products, including colours, ingredients and packaging, as accurately as possible. However, we do not warrant that product descriptions, images, or other content available on the Services are accurate, complete, reliable, current, or error-free. Minor variations between the product you receive and its representation on the Services may occur.
We reserve the right, at any time, to limit quantities, discontinue a product, correct errors, or refuse or cancel any order, including after an order has been submitted, for reasons such as inaccurate pricing, suspected fraud, or unavailability of stock.
4. Pricing and Payment
All prices are displayed in Pound Sterling (GBP) and include VAT where applicable, unless stated otherwise. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.
Payment is processed securely at checkout through Stripe, our payment services provider. By providing payment details, you confirm that you are authorised to use the payment method and authorise us (or our payment processor) to charge the full order amount, including shipping and any applicable taxes, to that payment method. We do not store your full payment card details ourselves.
5. Order Acceptance
Your order is an offer to purchase a product. We may accept or decline your order at our discretion. A confirmation email acknowledging receipt of your order does not constitute our acceptance of that order — a contract between you and us is only formed once we send you a dispatch confirmation, or once the products are delivered to you, whichever comes first.
6. Shipping and Delivery
We currently ship to addresses within the United Kingdom. Estimated delivery times are provided for guidance only and are not guaranteed. Risk of loss and title to products pass to you once the products are delivered to the shipping address you provided.
Please see our Shipping Policy for further details on dispatch times, carriers, and delivery charges.
7. Returns, Refunds and Your Right to Cancel
If you are a consumer contracting with us over the internet, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within 14 days of receiving your goods, without giving any reason, subject to the exceptions below.
Because of hygiene and health reasons, we are unable to accept returns or offer refunds on skincare, cosmetic, or personal care products where the seal, packaging, or hygiene protection has been opened, used, or removed, except where the product is faulty, not as described, or otherwise defective, in accordance with your statutory rights.
Please see our Refund Policy for full details on how to request a return, exchange, or refund.
8. Skincare and Product Use
Our products are intended for external use in accordance with the instructions provided on the packaging or product page, and are not a substitute for professional medical advice, diagnosis, or treatment.
- Always read the full ingredients list before use, particularly if you have known allergies or sensitivities.
- We recommend performing a patch test on a small area of skin at least 24 hours before first full use of any new product.
- Discontinue use immediately and consult a doctor or pharmacist if you experience irritation, redness, or any adverse reaction.
- Keep all products out of reach of children.
- If you are pregnant, breastfeeding, or have a pre-existing skin condition, we recommend consulting a healthcare professional before use.
Any product claims made on the Services are for general informational purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
9. Reviews and User Content
If you submit a product review, photo, or other content to us (“User Content”), you grant us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display, and publish that User Content in connection with the Services and our marketing. You confirm that any User Content you submit is your own, is accurate, and does not infringe the rights of any third party. We reserve the right to remove or decline to publish any User Content at our discretion.
10. Intellectual Property
All content on the Services, including text, graphics, logos, images, and software, is the property of Lumihour or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent.
11. Prohibited Uses
You agree not to use the Services: for any unlawful purpose; to violate any applicable laws or regulations; to transmit any malicious code; to attempt unauthorised access to any part of the Services; or to interfere with the proper functioning of the Services.
12. Third-Party Links
The Services may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.
13. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services or any products purchased through them. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded or limited under applicable law.
14. Your Statutory Rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or other applicable UK consumer protection legislation, including your rights in relation to goods that are faulty, not as described, or not fit for purpose.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of England and Wales. If you are a consumer resident in the UK, you may bring proceedings in the courts of the part of the UK in which you live, and mandatory consumer protection laws of your country of residence will also apply.
